These Terms apply to all visitors, users, and customers of this website. They govern your use of vanessaochi.com and purchases made through my online shop. My Shipping & Returns policy contains the specific terms regarding shipping, delivery, returns, refunds, damaged shipments, and international orders. All original artworks, prints, photographs, artwork images, text, graphics, logos, and other content displayed on this website are protected by applicable copyright and intellectual property laws. The purchase of an original artwork or print transfers ownership of the physical item only. It does not transfer any copyright, reproduction rights, or other intellectual property rights. All copyrights, reproduction rights, and other intellectual property rights remain with Vanessa Ochi unless otherwise agreed in writing.
Use of Purchased Artwork
Purchased artwork may be displayed for personal use. The artwork may not be reproduced, digitally copied, modified for reproduction, distributed, or used for commercial purposes without my prior written permission. This includes, but is not limited to, reproduction on merchandise, promotional materials, advertising campaigns, digital products, NFTs, or other commercial applications.

Artwork & Product Information
My original artworks are individually hand-painted and are unique pieces. Because of the handmade nature of my artwork, variations in texture, brushwork, paint application, surface structure, and materials may occur. These characteristics are an inherent part of original artwork and are not considered defects. I make every reasonable effort to display artwork colors as accurately as possible. However, colors may appear slightly different depending on your monitor, screen, device, lighting conditions, or individual display settings. Dimensions, materials, and other product specifications are provided as accurately as possible in each individual product listing. Please carefully review the product information before placing an order.
Prices, Taxes & Payment
All prices displayed on this website are in US Dollars (USD) unless otherwise stated. Applicable sales tax will be calculated during checkout based on the shipping address and applicable tax laws. Payment must be completed through one of the payment methods offered during checkout. An order will only be processed once payment has been successfully received.
Orders & Availability
All orders are subject to availability. Many of my artworks are one-of-a-kind originals and can therefore only be purchased once. I reserve the right to cancel an order in exceptional circumstances, including obvious pricing or technical errors, suspected fraudulent transactions, or situations in which an artwork is no longer available. If I cancel an order after payment has been received, the amount paid for the cancelled order will be refunded.
Shipping & Returns
Shipping, delivery, returns, refunds, damaged shipments, and international orders are governed by my Shipping & Returns policy. Please review the Shipping & Returns policy before placing an order. The Shipping & Returns policy forms part of these Terms. Nothing in these Terms or the Shipping & Returns policy is intended to limit any rights or remedies that cannot legally be excluded or limited.
Commissioned Artwork
Commissioned artworks are created specifically according to an individual customer's requirements. Details such as the artwork specifications, dimensions, colors, price, payment terms, and estimated completion time may be agreed upon separately between the customer and Vanessa Ochi. The return and cancellation conditions applicable to commissioned artwork are set out in my Shipping & Returns policy and any separate agreement relating to the commission.

You agree to use this website only for lawful purposes and in a manner that does not infringe upon my rights or the rights of any third party.
You may not:
reproduce or commercially exploit website content without permission;

Force Majeure
I shall not be responsible for delays or failures caused by circumstances beyond my reasonable control, including but not limited to natural disasters, severe weather, war, governmental restrictions, strikes, carrier disruptions, internet or technical failures, or other unforeseen events.
Governing Law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles and without giving effect to the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by applicable law. Any disputes arising from these Terms or a purchase shall be subject to the applicable courts in Michigan, USA, unless mandatory applicable law provides otherwise. For consumers located outside the United States, nothing in these Terms is intended to deprive them of mandatory consumer rights or protections that apply to their purchase and cannot legally be excluded.
